About our Privacy Policy

Endurance AI Privacy Policy

Last Updated: April 12, 2025

Endurance AI is committed to protecting your privacy. We
provide sales automation services to small businesses and private consumers in
the United States. This Privacy Policy explains what information we collect,
how we use and share it, and your rights regarding that information. Because we
operate exclusively in the U.S., this Policy is focused on U.S. privacy laws
(such as the California Consumer Privacy Act) and not GDPR. By using Endurance
AI’s website or services, you agree to the practices described in this Privacy
Policy.

Information We Collect

We collect personal information from you to provide our
services effectively. This includes:

Personal
Identifiers: Your name, email address, phone number, and shipping address. We
collect these details when you sign up for our services, request a demo, place
an order, or otherwise voluntarily provide the information to us.

Transactional
and Communication Data: Records of communications and interactions with you
(such as emails, phone calls, or support requests) and any information you
provide when communicating with us.

Website
Usage Data: When you visit our website or use our online services, we may
automatically collect certain information about your device and usage. This can
include your IP address, browser type, pages visited, and the date/time of
visits. We collect this through cookies and similar tracking technologies (see
Cookies and Tracking Technologies below). This data helps us understand how
visitors interact with our site and ensure the website is optimized for
usability.

We do not knowingly collect sensitive personal information
(such as social security numbers or payment card details) or information from
children under 13. Our services are intended for adults and businesses, and we
do not knowingly solicit data from minors.

How We Use Your Information

We use the information collected for various business
purposes consistent with providing and improving our sales automation services.
The ways we use your information include:

Providing
Services: To set up and maintain your account, and to deliver the sales
automation services you request. For example, we use your information to run
campaigns, automate sales communications, and manage any shipments or
deliveries you require.

Communication:
To communicate with you about your account, send service updates or
notifications, and respond to your inquiries. We may email or call you to
provide customer support, send confirmations, technical notices, or
administrative messages related to the service.

Shipping
and Logistics: If our service involves delivering physical items (such as sales
materials or devices), we use your shipping address and contact info to arrange
shipping and delivery through trusted carriers.

Improvement
and Optimization: To analyze service usage and improve our offerings. For
instance, we review website usage data and feedback to troubleshoot issues,
personalize your experience, and enhance the functionality and
user-friendliness of our platform. This helps us optimize our website and
services for performance and relevance.

Marketing
(with your consent): To send you marketing communications about new features,
services, or special offers that may be of interest to you. We might use your
email to send newsletters or promotional materials, but only in accordance with
applicable law. You can opt out of marketing emails at any time (see Your
Rights and Choices below).

Legal and
Compliance: To comply with applicable laws, regulations, and legal obligations.
For example, we may use your information to enforce our contracts and terms of
service, to prevent fraud, resolve disputes, or to ensure the security and
integrity of our operations. Using data for these purposes helps protect our
rights and the safety of our users.

We will only use your personal information for the purposes
outlined above or for purposes that are compatible with those. If we need to
use your information for an unrelated purpose, we will notify you and obtain
your consent when required.

Sharing of Information

We value your privacy and do not sell or rent your personal
information to third parties for profit. We share your information only in the
following circumstances:

Service
Providers and Partners: We may share data with trusted third-party companies
that perform services on our behalf to support our business operations. This
includes partners providing analytics, customer relationship management (CRM)
software, email delivery services, web hosting, or shipping carriers that
deliver products. These service providers are given access only to the
information necessary to perform their functions, and they are contractually
obligated to use it solely for our purposes and to keep it confidential. For
example, we might use a third-party email platform to send newsletters or a
shipping company to deliver an order.

Third-Party
Tools Integration: Endurance AI uses third-party tools for analytics, CRM, and
email as part of our service delivery. When we integrate these tools, certain
data (like your contact details or website usage info) may be processed by
those providers on our behalf. We ensure that these providers handle your data
with care and in line with this Privacy Policy. Each provider may have its own
privacy policy, but they are not allowed to use your data for their own
purposes beyond providing services to Endurance AI.

Legal
Compliance and Protection: We may disclose your information if required to do
so by law or in the good-faith belief that such action is necessary to comply
with legal obligations. This includes responding to valid subpoenas, court
orders, or government requests. We may also share information when we believe
it’s necessary to investigate or enforce our agreements, or to protect the
rights, property, and safety of Endurance AI, our customers, or others (for
example, to prevent fraud or security threats).

Business
Transfers: If Endurance AI is involved in a merger, acquisition, bankruptcy, or
sale of all or a portion of its assets, your personal information may be
transferred to the successor or affiliate as part of that transaction. In such
cases, we will ensure the new owner continues to honor the privacy commitments
we have made. You will be notified via a prominent notice on our website of any
change in ownership or uses of your personal information.

With Your
Consent: In situations where you have given us direct consent to share your
information with a specified third party, we will do so. For instance, if you
request that we refer you to a partner or integrate with a third-party service
on your behalf, we will share the information necessary to fulfill your
request.

Aside from the purposes above, Endurance AI will not share
your personal data with third parties. In particular, we do not sell personal
information to data brokers or advertisers, and we do not share your
information for third-party marketing without your explicit consent. Any third
parties who process your data must follow strict confidentiality and security
obligations consistent with this Policy and applicable law.

Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies
to enhance your experience and gather information about how our site is used.
Cookies are small text files that websites place on your device to store data
that can be recalled by the web server in the domain that placed the cookie. We
use these technologies for several reasons:

Website
Functionality: Some cookies are essential for the site to function properly.
They allow you to navigate the website and use basic features. For example, if
our service has a login portal, cookies might keep you logged in during your
session.

Preferences:
Cookies can remember your preferences (like language or region) to provide a
more personalized experience. This means you don’t have to re-enter information
each time you visit.

Analytics
and Performance: We utilize cookies to collect information about how visitors
use our website. This data (such as which pages are visited most often, how
users move through the site, and if they encounter errors) helps us understand
user behavior. By analyzing these patterns, we can improve our website design,
content, and overall user experience. In short, cookies help us better
understand how visitors interact with our site and ensure our website is
optimized for performance.

Marketing
and Advertising: We may use cookies for marketing purposes, such as
understanding which services you are interested in. For instance, if you visit
certain pages, we might use that information to send you more relevant
marketing communications (if you have subscribed to them). Cookies may also be
used to measure the effectiveness of our advertising campaigns. We do not
engage in third-party advertising networks that track you across different
sites, but we may use our own cookies or third-party analytics cookies to track
conversions from our advertisements and to serve content tailored to your
interests on our site.

In addition to our own cookies, we might partner with
third-party analytics tools (like Google Analytics) that set their own cookies
to collect usage statistics on our behalf. These tools help us analyze how
users use the site (for example, Google Analytics may tell us how often users
visit, what pages they look at, etc.) and they provide reports that we use to
improve the service. We ensure any third-party cookies we allow are used only
for our internal purposes as described.

Your Choices for Cookies: You have the right to decide
whether to accept or reject cookies. Most web browsers automatically accept
cookies, but you can usually modify your browser setting to decline cookies or
alert you when a cookie is being placed on your device. Please note that if you
disable or reject certain cookies, some parts of our site may become
inaccessible or not function properly (for example, site preferences might not
be saved). For guidance on how to adjust your browser settings, you can consult
the help documentation for the specific browser (e.g., Chrome, Firefox, Safari,
Edge).

“Do Not Track” Signals: Some browsers offer a "Do Not
Track" (DNT) feature that lets you signal to websites that you do not want
to be tracked. Currently, there is no uniform standard for how to respond to
DNT signals. As a result, Endurance AI’s website does not respond differently
to Do Not Track signals. We continue to monitor industry and legal developments
around DNT. Rest assured, even if you have enabled DNT, you can still control
tracking through the cookie preferences described above.

Data Security

We take data security seriously and implement reasonable
administrative, technical, and physical safeguards to protect your personal
information. These measures are designed to prevent unauthorized access,
maintain data accuracy, and ensure the appropriate use of information. For
example, we use secure servers and may employ encryption protocols (such as
HTTPS/SSL) to protect data in transit. We also restrict access to personal
information to authorized personnel on a need-to-know basis and provide training
to our staff on data protection best practices.

However, please be aware that no method of transmission over
the Internet or electronic storage is 100% secure. While we strive to protect
your data with commercially acceptable means, we cannot guarantee its absolute
security. It is important for you to also play a role in keeping your
information safe. We encourage you to use strong passwords for your accounts
and not share them with others. If you believe that the security of your
personal information has been compromised, please contact us immediately (see
Contact Us below).

In the event of a data breach that affects your personal
information, we will notify you and the appropriate authorities as required by
law. We continuously review and update our security practices to adapt to new
threats and to protect your privacy.

Your Rights and Choices

You have certain rights and choices regarding your personal
information. We want you to be informed and in control of how your data is
used. This section describes both the general rights available to all our
customers and additional rights for California residents.

Access and Update Your Information: You may contact us at
any time to request access to the personal information we hold about you. We
will provide you with a copy of your information or let you know what data we
have, as required by law. If any of your personal details are incorrect or have
changed (for example, you need to update your phone number or shipping
address), you have the right to request a correction. We encourage you to keep
your information up-to-date and will honor requests to correct inaccurate
information.

Deletion of Information: You can also request that we delete
the personal information we have collected from you. We will delete your data
upon request, provided we do not have a legal obligation or a legitimate
business reason to retain it (for instance, certain records might be kept to
comply with financial reporting or to resolve disputes). Do note that if you
request deletion of certain information, it may affect our ability to provide
you with services (e.g., if you delete your email address, we would no longer
be able to contact you). We will let you know if any exception applies in your
case.

Opting Out of Marketing Communications: If you prefer not to
receive promotional emails or newsletters from us, you have the choice to opt
out. You can do so by clicking the "unsubscribe" link in any
marketing email we send. Alternatively, you may contact us directly (via email
or the contact methods below) and request to be removed from our marketing
list. Please note that even if you opt out of marketing messages, we may still
send you important service or transactional communications (such as account notices,
updates about your service, or responses to your inquiries) as these are not
promotional in nature. We respect your choice and will process unsubscribe
requests promptly.

Cookie Choices: As described in the Cookies section, you
have control over cookie preferences. You can adjust your browser settings to
remove or reject cookies, and you can opt out of certain analytics tools (for
example, Google Analytics offers an opt-out browser add-on). Using these
options allows you to limit the data collected through tracking technologies.
Keep in mind that essential cookies might be needed for some service
functionality.

California Privacy Rights

If you are a California resident, you are entitled to
additional rights under the California Consumer Privacy Act (CCPA) (as amended
by the California Privacy Rights Act). The CCPA gives California consumers more
control over their personal information and provides specific rights, including
the right to know what personal information a business has collected about you,
the right to request deletion of that information, and the right to opt out of
the sale of your personal information (among other rights). In summary,
California residents have the following rights:

Right to
Know: You have the right to request that we disclose what personal information
we have collected about you. This includes the categories of information
collected, the sources of that information, the business purpose for collecting
it, and the categories of third parties with whom we share the information.
Upon a verified request, we will provide a report detailing this information
for the 12-month period prior to your request (as required by law).

Right to
Delete: You have the right to request that we delete personal information we
have collected from you. Upon verification of your request, we will delete your
personal information from our records (and direct our service providers to do
the same), unless an exception applies. For example, we may retain information
needed to complete a transaction you requested, to detect security incidents,
to comply with legal obligations, or other reasons permitted by the CCPA.

Right to
Opt-Out of Sale of Personal Information: You have the right to direct us not to
sell your personal information to third parties. It’s important to note that
Endurance AI does not sell personal information to third parties in the
ordinary course of business. We do not share your data for monetary value or
for behavioral advertising in a way that constitutes a “sale” under the CCPA.
However, if that practice ever changes, we will update this policy and provide
a clear way for you to exercise your opt-out right.

Right to
Correct: You have the right to request that we correct any inaccurate personal
information we hold about you. If you believe that any of your information is
incorrect or outdated, you can request a correction and we will address it,
taking into account the nature of the information and the purposes of
processing.

Right to
Non-Discrimination: We will not discriminate against you for exercising any of
your CCPA rights. This means that if you choose to exercise your privacy rights
(for example, by requesting deletion or opting out of data sale), we will not
deny you our services, charge you a different price, or provide a lesser
quality of service just because you exercised your rights. The CCPA prohibits
businesses from penalizing consumers for exercising their privacy
rightsoag.ca.gov, and we fully uphold this commitment.

Exercising Your California Rights: If you are a California
resident and wish to exercise any of the above rights, you (or an authorized
agent acting on your behalf) can submit a request to us through the contact
information provided in the Contact Us section below. Please specify which
right you intend to exercise (access/know, deletion, correction, or opt-out).
For your privacy and security, we will take steps to verify your identity
before fulfilling your request – typically by asking you to provide certain
information that we can match against our records. We will respond to
verifiable requests within the timeframe required by law (generally within 45
days, with the possibility of an extension if necessary, which we would
communicate to you).

These rights under California law are subject to certain
limitations and exceptions. If we cannot comply with a part of your request, we
will explain the reason in our response (for instance, if we are prohibited
from deleting data due to a legal obligation). Rest assured, Endurance AI is
dedicated to honoring your privacy rights to the fullest extent possible.

Other State Privacy Rights: Some other U.S. states have
enacted their own privacy laws. If you are a resident of states such as
Colorado, Virginia, or others that provide privacy rights, we will extend
similar rights and choices to you regarding access, deletion, or opting out of
certain data uses, in line with the applicable state law. You can contact us
for more information or to exercise those rights, and we will assist you in
accordance with relevant laws.
